"Sometimes you fall down and scrape your knee. Sometimes you bump your head. I'll be sorry forever. I didn't have a right to take a life 'cause I never brought life into this world."

Clark and Crosland pleaded guilty to voluntary manslaughter while armed in September 2011, saying that they both shot at Minger, who was at Clark's girlfriend's home. Crosland said Minger had pistol-whipped him in a robbery and shot at a friend of his.

When Clark and Crosland arrived at the girlfriend's home and saw Minger there, they pulled out revolvers and shot at him, striking him five times including in the face and abdomen. Minger, 17, was identified by his fingerprints. Prosecutor Jeff Pearlman said Minger was unarmed when he was killed.

"What happened in that apartment was a horror show," Pearlman said.

Clark's attorney, Madalyn Harvey, disagreed.

"This was not a brutal killing," she said. "This was spontaneous. If this case had gone to trial, there would have been serious doubts about what prompted Mr. Clark to act in this manner. The court has to focus on the conduct of (Minger). There are strong mitigations here."

Clark and Crosland were arrested in January and February 2011, respectively, each on suspicion of first-degree murder. They were 23 and 17 years old. They each pleaded guilty to voluntary manslaughter while armed in September 2011.

On Friday Motley sentenced Clark to 17 years in prison and Crosland to 14 years in prison. Clark's sentence was longer because he has a criminal history, but each of the sentences was the maximum mandated by sentencing guidelines.

"Every human life has value," Motley said. "Even the decedent who had problems or trouble, he could have turned his life around. He has no opportunity [to do that now]."

Crosland, who will turn 18 years old on Saturday, addressed Minger's mother, who was present for the sentencing.

"I'm very sorry for what happened," he said. "I feel bad for what happened. I feel terrible for what happened. I put that grief there and I'm sorry."
Laura AmicoFri, 17 Feb 2012 16:03:04 -0500http://homicidewatch.org/2012/02/17/judge-imposes-maximum-sentences-for-shooting-death-of-se-dc-teen/Ricardo Vondell MingerKevin Lamont ClarkDonald CroslandKevin Clark, Donald Crosland Plead Guilty in Death of Ricardo Mingerhttp://homicidewatch.org/2011/09/12/kevin-clark-donald-crosland-plead-guilty-in-death-of-ricardo-minger/
Kevin Clark and Donald Crosland today pleaded guilty to charges that they shot and killed 17-year-old Ricardo Minger in a Southeast D.C. apartment in January.

Clark, 23, and Crosland, 17, could be sentenced to five to thirty years in prison for the crime.

The voluntary manslaughter plea is a significant reduction from the first-degree murder charge they were each indicted on in June.

Minger, a 17-year-old resident of Southeast D.C., was shot in the face and abdomen Jan. 7 in an apartment in Southeast D.C. He was identified by his fingerprints, according to court documents in the case against Clark.

Crosland, known to friends as "D," is alleged to have shot at Minger at the same time as Clark the night that Minger was killed.

According to charging documents in the case,

[Witness 1] observed [Clark] walk to the balcony window of the apartment and look out the balcony door. [The witness] then observed [Clark] take out a revolver style handgun that was silver with a brown handle. At the same time, [the witness] observed [Crosland] with his hands in the waistband and him also produce a revolver style handgun. Then, [the witness] observed [Clark] and [Crosland] repeatedly shoot [Minger] at close range.

Four bullets and fragments were recovered from the crime scene and Minger's autopsy, two were determined to have been shot from the same gun, but the remaining two bullets were "too damaged" to evaluate what gun had shot them, court records state.

Sentencing is scheduled for Dec. 7.

Read a press release from the U.S. Attorney's Office below.

Two Plead Guilty to Charges In January 2011 Slaying of District Teenager

WASHINGTON - Kevin Clark, 23, and Donald Crosland, 17, pled guilty today to voluntary manslaughter and weapons charges in a killing that took place earlier this year in Southeast Washington, U.S. Attorney Ronald C. Both defendants, armed with firearms, shot Minger multiple times, and he subsequently died from his injuries.

In announcing the plea, U.S. Attorney Machen commended those who worked on the case from the Metropolitan Police Department’s (MPD) Violent Crimes Branch, along with MPD Detectives Ray Shields and William Covington, and the Mobile Crime Branch, including William Hyatt. A group of Kevin Lamont Clark’s family members looked on as Judge Russell Canan determined probable cause to hold Clark for first premeditated degree murder while armed Tuesday morning in a D.C. courtroom.

According to Metro Police Homicide Detective William Covington, witnesses in the southeast D.C. apartment familiar with the defendant were present at the time of the shooting.

They reported to police that on January 7, Clark and two other men (referred to in court as Suspects 1 and 2) entered the apartment. Clark crossed the room, looked out a sliding glass door, and pulled a revolver. He glanced back at Minger, seated on the couch, and Suspect 2 before opening fire on Minger, who took five bullets to his head and torso.

“There was something that happened between the decedent and suspect number two,” the detective said when asked about possible motives.

The defense noted that both witnesses changed their stories during the investigation, attempting to connect these changes of heart with promises of police assistance.

The prosecution, though, argued that the first witness’s romantic relationship with Suspect 2 led her to omit his participation in the shooting from earlier Grand Jury testimony.

The second witness originally claimed to have been in the bathroom during the shooting. Both witnesses initially said they “didn’t want to get anybody in trouble.” Asked why the witness lied, Detective Covington told the court, “[The witness] was in love” with Clark.

Many details are still being confirmed, including whether Clark was the only shooter or if he was joined by Suspect 2, and if so, who shot first. The prosecution argued, however, that witness testimony about Clark’s actions never wavered.

The defense asked that Clark be released to a halfway house, but Judge Canan ordered him held without bond based on the seriousness of the charges. He also noted Clark’s history of convictions and a reported loss of contact with his parole officer since July 2009.

Charging documents are available here.

Mia Bonarski has served as an advocate for substance abuse issues, a copy-editor for a post-conflict research office, a public opinion researcher in Kabul, Afghanistan, and a polling center representative for south Sudan.
