He had been shot multiple times in the neck, back and left knee area, according to plea documents.</p> <p>A witness told police that the men were part of a group trying to resolve a neighborhood argument about an assault, according to court documents. The witness said that during the conversation, Burks made “references to ‘gun play’ and further altercations that would occur over the next week,” state documents. </p> <p>MPD Detective Gabriel Truby <a href="http://homicidewatch.org/2014/03/28/andre-burks-held-on-probable-cause-in-shooting-death-of-antwan-boseman/">testified in a preliminary hearing</a> held March that the shooting stemmed from two fights earlier on August 3, each fight more violent than the last.</p> <p>The proffer of facts states simply that Burks got into an argument with Boseman while in the 800 block of Barnaby Street Southeast. Both were transported to the hospital. Boseman died and the other man survived.</p> <p>At a preliminary hearing Friday, MPD Detective Gabriel Truby testified that the shooting stemmed from two fights earlier on August 3, each becoming more violent than the last.<br /> <span id="more-22001"></span><br /> After the second fight, prosecutors said, Burks made reference to “gun play” that would ensue if his opponents didn’t back down, Truby testified that a witness told him.</p> <p>Truby described two opposing groups of men from the apartments as being from either the "Up Top" or the "Down Bottom" group. </p> <p>"There was a retaliatory fistfight before the shooting," said Truby.</p> <p>About an hour after the exchange, Truby said, Burks, Boseman, and others argued again. One man attempted to shoot a gun in the air, but it malfunctioned. </p> <p>Truby said that one witness described that after hearing shots they looked up and saw Burks pointing a gun at Boseman, still arguing with him. The witness ran for cover and heard several gunshots.</p> <p>Burks' defense attorneys argued that those accounts though were not to be trusted. According to the documents, the witness further reported that Boseman "took exception" to Burks comments and the two exchanged words before Burks left the area.</p> <p>Shortly after that, the witness said that Burks and two other individuals followed Boseman out of a nearby walkway. According to the witness, Boseman started to argue with Burks and the two other men. Then one of the other individuals stepped away and produced a handgun, the witness told police. The individual tried to shoot the gun in the air, but the gun malfunctioned, according to the witness. The second person with Burks took the gun and approached Boseman, the witness said. </p> <p>The witness chose that moment to run for cover in a nearby building, documents state. In the building, the witness said that it heard several gunshots. After the witness left the building, it saw Boseman and Burks suffering from gunshots, court documents state. </p> <p>Another witness told police that after hearing a gunshot and someone yell, "I'm hit!", the witness saw Burks pointing a gun at the surviving victim. This witness said that Boseman stood in front of Burks, arguing with him. The witness also chose to run for cover and heard several gunshots, documents state. When they arrived they found Robinson, of Southeast Washington D.C., suffering from multiple gunshot wounds. He was taken to a local hospital where he died. </p> <p>Robinson was the second man to die Saturday.
