The sentencing was a significant and substantial departure from guidelines which recommended 15 to 26 years in prison.</p> <p>"You've just been committing violent crimes for 25 years," Canan told Hayes Friday. "I have no confidence at all that you will ever change your ways."<br /> <span id="more-17952"></span><br /> Hayes was found guilty in July of second-degree murder while armed in Griffin's death. </p> <p>At sentencing Friday, Hayes' defense attorney, Russell Hairston, said that Hayes was never given proper mental health services as a juvenile, which has led to a lengthly criminal history. Prosecutors in the case said Friday that Hayes has been arrested over 25 times, and that he would never be rehabilitated.</p> <p>Griffin, 42, was stabbed seven times on May 18, 2012 around 9:30 pm on the 1200 block of North Capitol Street Northwest. He was transported to a local hospital where he was pronounced dead.</p> <p>Three days later Hayes was arrested and held connection with the case.</p> <p>According to charging documents, witnesses told police that the night of the murder, Hayes chased Griffin into the street where they began to fight. Hayes threw several strikes at Griffin, and knocked him to the ground. Hayes then stood over Griffin with a knife in his hand and said, “fuck the police,” then fled. </p> <p>Hayes was <a href="http://homicidewatch.org/2013/02/22/herbert-hayes-arraigned-on-first-degree-murder-charges/" >indicted in February</a> on a first-degree murder charge, but in July a <a href="http://homicidewatch.org/2013/07/12/herbert-hayes-found-guilty-of-john-wesley-griffin-murder/" >jury found him guilty</a> of second-degree murder while armed. </p> <p>During the trial <a href="http://homicidewatch.org/2013/07/10/on-stand-herbert-hayes-says-he-never-stabbed-john-wesley-griffin/" >Hayes claimed</a> that he never stabbed Griffin and that the prosecution’s witnesses were “coerced against” him. </p> <p>"There's a lot of evidence I didn't get to display in trial," Hayes said Friday. Griffin was transported to a local hospital where he was pronounced dead.</p> <p>During trial Hayes testified that he never stabbed Griffin and that the prosecution's witnesses were "tricked and coerced against" him. But the prosecution argued that the stabbing was premeditated and that Hayes deliberately stabbed Griffin, then "boasted" to his friends and his girlfriend about what he did. </p> <p>Griffin's niece, Mildred Williams, wept outside the courtroom after the verdict, hugging Assistant US Attorney Adrienne Dedjinou saying "Thank you so much, I needed this."</p> <p>"I'm going to miss his smile, his laugh and his good nature. "I don't know that dude to do anything like that to him."</p> <p>Hayes is charged with first-degree murder while armed in connection with Griffin's death. On May 18, 2012, Griffin suffered four stab wounds, including two to his back; he was found in the 1200 block of North Capitol Street Northwest around 9:45 p.m.<br /> <span id="more-16132"></span><br /> Prosecutors say Hayes stabbed Griffin during an altercation that occurred after they both visited a residence in the Tyler house apartment building. Hayes told jurors Wednesday that he did not stab Griffin, nor did they have an altercation. </p> <p>What Hayes said did happen was that on May 18 he received a call from a man named Keith Wills asking him to meet near North Capitol Street NW to pick up $7,000. Hayes and Wills sold clothing together, Hayes said, and it was time to collect his half of the profits. After some initial miscommunication, Hayes met his friend in the evening and collected his profits in a brown duffel bag, he told jurors. </p> <p>But on the stand Wills testified differently. He said Hayes called him and asked where to find Griffin; shortly afterward, Hayes "popped up on a bike." Wills said that he saw Hayes with a knife, adding, "everybody carries weapons" in that area. Wills testified that later that night he saw Griffin and Hayes together. He said he saw them talking at first, "then I closed my eyes," he said. </p> <p>On the stand Wednesday, Hayes told jurors that prosecutors had "got a hold of Wills," and that Wills did not see him with a knife, because he didn't have one. </p> <p>Hayes also said that testimony of Cornelius Johnson, a security officer at Tyler House apartments, could not be trusted.</p> <p>Johnson had testified that while patrolling the area on the night of the murder, he saw Griffin run into the street, yelling for police, with Hayes chasing him. Johnson said that when Griffin reached the street, he turned to Hayes and raised his fists. </p> <p>"I saw [Hayes] throw what seemed like forward strikes to [Griffin's] upper body," Johnson said. "Then I saw [Hayes] stand over [Griffin]; I saw a blade in his right hand." </p> <p>Johnson said he chased Hayes for several blocks, but Hayes got away.</p> <p>Hayes told jurors that Johnson was "one officer that had a grudge against me." </p> <p>"We was messin' with the same women and he wanted me out of the building," Hayes said. </p> <p>Marvelette Speller, Hayes' ex-wife, testified that Hayes called her around ten times on the night of the murder, and on the last call told her he stabbed someone. At 9:30 that evening, Griffin was seen running down North Capitol Street, screaming for police, as Hayes chased him, prosecutors say. </p> <p>Charging documents in the case say that a <a href="http://homicidewatch.org/2012/06/20/substantial-probability-found-for-herbert-hayes-second-degree-murder-charge/" >witness saw Hayes with a knife</a>. </p> <p>Another eyewitness is expected to testify that he saw Hayes make "punching motions" that dropped Griffin to the sidewalk. The eyewitness then heard Hayes yell, "f- the police," according to prosecutors. </p> <p>Hairston argued, though, that this witness "can't tell the truth." </p> <p>The witness lost his job because of lies he told as a police officer in Prince George's County. This hurts the eyewitness' credibility, Hairston said. </p> <p>Dedjinou said that cell phone records place Hayes "minutes and moments" from the stabbing. Canan rescheduled the trial to begin June 24.</p> <p>Judge Canan ordered the evaluation last week after Hayes' previous attorney, Betty Ballester, disclosed that <a href="http://homicidewatch.org/2013/05/01/mental-health-evaluation-ordered-for-herbert-hayes-after-attorney-threatened/" >Hayes had threatened her</a>. At that time, Canan said that he suspected that Hayes had threatened two other attorneys as well. Based on Ballester's statement, Canan appointed a new attorney, Russell Hairston, to the case. <span id="more-14641"></span></p> <p>"You've now had three excellent lawyers that the court has appointed you," Canan told Hayes Friday. You can't dictate to me what lawyer is going to represent me.”</p> <p>Canan warned Hayes that this is the last time he will be granted new counsel. </p> <p>“If you threaten another lawyer, you are not entitled to a new one,” Canan told Hayes. “Stick with your lawyer or represent yourself,” Canan said. </p> <p>The mental health evaluation is scheduled for May 10. The witness told police they then saw Hayes punch Griffin, who fell to the ground. Once Griffin fell, the witness saw that Hayes had a knife in his hand.
